Tory hits back at province for transit and relief line funds

Early Tuesday morning, Toronto Mayor John Tory sent a letter and a list of budget recommendations to Ontario Minister of Finance, Charles Sousa, calling on Ontario to become “a full partner in cost-sharing of major infrastructure investments going forward.”

The letter outlines Toronto’s infrastructure expectations given the province’s rejection of tolls. Tory said the province has an “obligation” to help the city pay for the maintenance of both the Don Valley Parkway and the Gardiner Expressway, in addition to helping pay for new lines in the transit network, like the Yonge Relief Line.

Tory’s budget recommendation included the approval of a new revenue tool — a levy on hotel and short-term accommodation. The city of Toronto needs legislative authority from the province in order to tax lodgings; however, it doesn’t want this tool to interfere with the funding already given to Tourism Toronto. Tory is proposing a four per cent tax on hotels and short-term accommodations like airbnb.

In addition to a revenue tool, Tory has outlined a list of recommended items the province should fund, including $820 million to help rehabilitate the Gardiner Expressway, $3.36 billion for the transit network plan, $863 million for Toronto Community Housing, and $50 million for child care subsidies.

These recommendations follow a public exchange by Tory and Ontario Minister of Transportation, Steven Del Duca on Monday, in which Tory told the media the province was not acting like a “full partner” in their commitment to build transit. Tory stood at the Bloor – Yonge subway platform and said the province needed to come up with a plan to help contribute to the relief line and other transit projects. He suggested the province, as well as the federal government, each contribute 40 per cent of the funds for the project. Toronto would then pay for the remaining 20 per cent.

Del Duca responded with his own press statement, saying the Ontario government has “always been a strong partner with Toronto city council” and that they were “not going to play political games with transit.” With words bolded and underlined, Del Duca mentioned the measly $150 million the provincial government has already pledged to the relief line and claimed to be a “stable provincial funding partner at the table” unlike the federal government.

The reality is that Toronto needs billions to develop its transit network — a network that will benefit residents throughout the GTHA as more people use public transportation instead of driving on already congested roadways. The refusal of the provincial government to allow Toronto to fund its own projects through revenue tools like tolls puts projects like the downtown relief line in jeopardy. Toronto’s growth and development is, effectively, at the mercy of Queen’s Park.

Tory understands this and is fighting back. He is trying to make it abundantly clear that if the province doesn’t allow Toronto to explore and use its own revenue tools, then it has to step up to the plate and help pay for these important projects.

There are universal benefits to developing Toronto’s transit network. It will help reduce carbon emissions as less people drive into the city. It will help connect the Greater Toronto Hamilton Area so that people can get from their home to work in a seamless manner. And it will help reduce congestion for those who have no choice but to use their car to get around.

Funding this network is a win-win scenario — and if the province is not going play politics with transit, they would see that.

City council votes in favour of Scarborough subway

After an entire day of debate, Toronto City Council voted Tuesday to approve the alignment and procurement model for the Scarborough subway.

The 6.2 kilometre subway will extend from Kennedy Station on the Bloor Line to Scarborough Town Centre along McCowan, as recommended by city staff. Council also approved the building of a new bus terminal that is meant to help create a “dynamic hub” that will attract businesses and build communities.

This is one of the final steps towards the actual construction of the subway. Staff will report back once procurement is at 30 per cent completion. It is currently sitting at five per cent.

All of city council agreed that having a transit system that connects Scarborough with the rest of the GTHA was necessary. As Toronto Mayor John Tory said while presenting this item to the rest of council, “in my respectful opinion, we need to move on.”

“The time for debate is over. It’s time to actually start building transit in Scarborough.”

The motion passed 26-18.

Why did this decision take a whole day? It’s because of the price tag. Councillors were shocked to find out that at just 5 per cent procurement, the Scarborough Subway had a price tag of approximately $3.56 billion, much higher than originally expected. When asked about this balloon in cost, the CEO of the Toronto Transit Commission noted the time that had passed since council originally decided to go forward with a subway. The longer council waits, the more expensive it will get.

Council came close to passing another motion that would have required staff to submit another report showcasing a business-cost analysis between the Scarborough subway and the seven-stop LRT alternative. According to city manager Peter Wallace, council had never asked for a comparison like this before. The motion was rejected 27-17.

Tory said that asking for another study will simply lead to another study, and then another. He pressed the need to start designing and building transit in Scarborough.

“I know in 30 years no one will question this decision,” Tory said.

Canada budget 2017 highlights transit and housing

At 4 p.m. on March 22, the Government of Canada released their 2017 budget. As Canada celebrates it’s 150th anniversary, this budget, entitled “Building A Strong Middle Class”, is being described by many as uneventful and uninspiring. There was a lot of emphasis on innovation and skill training; but at the same time, little money was dedicated to facing new problems such as immigration, refugees, and post-secondary education.

The budget creates a deficit of about $29 billion for 2016/2017. The Liberals plan on reducing that deficit to about $14 billion by the end of their term.

The Liberal government says this budget was created under a gender-based analysis, meaning that all aspects within the budget, even those that don’t pertain to gender, were assessed based on the impact it would have on women. A gender statement within the budget makes reference to the still-high gender gap in Canada and the additional violence women experience on a regular basis.

“When making decisions that significantly affect peoples’ lives, governments must understand to what extent their policy choices will produce different outcomes for all people,” the gender-statement in the 2017 budget reads.

“A meaningful and transparent discussion around gender and other intersecting identities allows for a greater understanding of the challenges this country faces, and helps the Government make informed decisions to address those challenges—with better results for all Canadians.”

Here are some of the other highlights within the budget:

Transit: The government has dedicated $20.6 billion, spread out over the next 11 years, to public transportation projects. This funding will be used to cover up to 40 per cent of new subways and rail light lines — which is big for cities like Ottawa and Toronto that are in the middle of creating large integrated transit systems.

At the same time, the government is eliminating the public transit tax credit, which allows transit users to claim 15 per cent of what they pay.

Infrastructure: With the growth of the affordable housing crisis, the federal government has decided to invest $11.2 billion over 11 years for affordable housing. This money will be divided into a few different programs, including $225 million will go towards improving housing conditions for Indigenous Peoples not living on reserves.

Child Care: The Liberal government is going to spend $7 billion on childcare, creating about 400,000 new subsidized childcare spaces in the next three years. Parental leave has also been increased to 18 months, and expecting mothers can claim Employment Insurance benefits up to 12 weeks prior to giving birth — it used to be eight weeks.

Skills/Training: Innovation Canada will be receiving $950 million over five years to support innovators and to build “super-clusters”. The budget also agrees to allow those on Employment Insurance benefits to apply to go back to school or undertake training, something which was not possible in previous years.

Green Party hopes to woo voters with honesty and revenue tools

The Ontario Green Party is working on a comprehensive revenue tool package that will help fund infrastructure and transit projects throughout the province. The package will include a plethora of options for drivers and transit users, including the use of tolls and congestion charges in addition to uploading the cost of maintaining and operating the Don Valley Parkway and the Gardiner Express back to the province.

“One of the biggest challenges facing the GTHA is gridlock,” says party leader Mike Schreiner. “It affects our economy to the tune of $6 billion in lost productivity.”

According to Schreiner, the Green Party is willing to do something other political parties are not — explain honestly and openly what it will take to improve transit and quality of life in cities across Ontario.

“This is a situation where political self-interest is trumping the people’s interest,” he says. “There is a myth that somehow all this infrastructure is going to be built. Imagine if our great grandparents hadn’t paid for dams in Niagara Falls that generates electricity … or hadn’t agreed to pay for the cost of the 400 series highways that enabled us to ship goods to province and the US. It’s time for our generation to step up to plate and fund transit infrastructure desperately needed.”

As part of this plan, the Green Party is supporting dynamic tolling, where drivers are charged a larger cost for using certain roadways like the Gardiner and DVP during on-peak hours and less (or not at all) during off-peak hours. The hope is that this will encourage those who can use transit, to do so, and those who must drive, to carpool.

“A toll taxes people regardless of time of day when real problem is rush hour,” says Tim Grant, Green Party shadow cabinet minister for transportation. “The dynamic road pricing – although it sounds harsh at first glance – is really fair and equitable. It acknowledges that there is a higher cost to discourage drivers in rush hours.”

The money collected from these tolls would be dedicated to transit, ensuring that those who choose to use alternative modes of transportation are able to use a modern and well-maintained system. It’s a win-win scenario — the challenge is to convince people the long-term benefits are worth the cost.

“If you reduce traffic congestion, people have a higher quality of life,” Grant says. “Air pollution is reduced, fuel economy is reduced, which leads to higher air quality and more time on [drivers] hands.”

Grant says the problem with the current funding provided by both the provincial and federal governments to municipalities for infrastructures is that it only pays for the initial planning and construction of a transit project, but not to operate or maintain it. This results in poorer service and low ridership.

Another aspect of the Green Party’s revenue plan is to upload the costs of operating and maintaining the DVP and Gardiner Expressway back to the province, something that was promised over 10 years ago. This would free up a couple billion dollars worth of funding the City of Toronto could use to build better transit infrastructure and maintain other roads within the city.

The key, both Schreiner and Grant say, is to actually listen to experts and communicate that information honestly to the public, without political agenda.

“Part of the problem is that political parties prepare their platform and policies based on a calculation of what voters think – and it’s a sad state because the alternative is for a political leader to go out and be honest and say, you won’t like this, but you will love it afterwards,” Grant said. “It needs political leadership willing to get out in front of all this and say we are doing this because people will get to work faster, kids will have better transit, and this will be a benefit. Vote for me or not – but I will try to make life better.”

The Green Party will discuss their platform and comprehensive revenue package in May in preparation for the 2018 election.

Forcing women to wear heels at work is abusive

Requiring a woman to wear high heels at work isn’t just sexist — but abusive.

Heeled shoes are painful. Despite how awesome they look and how powerful or pretty they make you feel, there is no scenario in which women will say, in relation to their heels, “these shoes make me feel like I’m walking on a cloud.”

Some women just don’t have the feet for high heels. They may have no arches, wide soles, or legitimate medical problems relating to feet or ankles, all contributing factors in not being able to squish into a narrow and pointy piece of plastic supported only by a skinny rod on one end. The result is blisters, sore callouses, and the potential of a sprained ankle.

Like I said. Forcing women into heels can be harmful. Personally, I only wear high heels to fancy events, job interviews, and sometimes on a night out — but only if those events, job interviews, and evenings out don’t involve a lot of walking. Honestly, I don’t even know why I bother half the time. I can’t imagine wearing heels eight hours a day, every day. Nor would I want to.

British Columbia parliamentarians have taken notice of this fact and are pushing forward legislation that will ban requirements for footwear dress codes based on gender, or more simply put, it would make it illegal for employers to force their female employees to wear high heels in the workplace.

Who wants to move to British Columbia? I can tell you my hand went up.

I am constantly disgusted by the mandatory dress codes in certain industries. When servers or restaurant hostesses are forced into skimpy dresses and clunky high-heel shoes, I always wonder about the safety factor — is it safe for these women to be balancing five drinks, a plate full of steak and potatoes, and a side order of fries, all the while wearing shoes that could be used as a lethal weapon if taken off the foot and thrown at a person’s head?

Or how about when a receptionist for a large law firm is sent home for not wearing the correct foot attire, as happened in the UK. Apparently, this offended the many people who actually stare at a person’s toes while they speak with them.

This is all getting a bit ridiculous, don’t you think? Especially in 2017, as more women become decision-makers and obtain positions of power.

I agree that sometimes a dress code is necessary. But, can we also agree there is no job that can be performed better in 5-inch stilettos? What’s wrong with a simple black flat or a working shoe with a very small and thick platform? For goodness sake, what’s wrong with being comfortable AND professional in the workplace?

All of the other provinces in Canada should follow British Columbia and create legislation of their own. There is no need for ridiculous and sexist dress codes in the workplace. If legislation banning them is what’s needed for companies to change their policies, then so be it.

Although, it’s worth being said, that if we need legislation to mandate companies not to force their female employees to dress a certain way, Canada probably isn’t as feminist as it claims to be.

Would you wear these clear panel mom jeans?

What has the fashion industry come to? I can sort of understand the distressed-jean look. The frayed-holes-in-the-thighs fad had a little potential in the rock and alternative rock era. But, and as much as I try to review fashion with an open mind,  even I can’t get past the newest denim craze — the clear panel mom jeans.

These retro-style high-waist cropped jeans have a clear plastic rectangle around the knee, allowing your friends, family, and strangers to admire that area of the female body that connects our calves to the rest of our legs. Because, apparently, that is cool.

This pant, which was released by Topshop, a British fashion retailer that provides clothing to Nordstrom and Hudson’s Bay in Canada, has become an overnight Internet sensation. People are responding with hilarious uses for these “knee windows”, such as using them as message boards or using them to avoid those pesky grass stains. A lot of people questioned the fact that these pants can be washed using a washing machine – but what would happen if you accidentally threw it in the dryer? Would your knee windows melt?

How does Topshop see these jeans? This is what it says on their website beneath a photo for these clear-panel creations: “Off-duty styling never looked so good. Crafted from pure cotton, our MOTO mom jeans come in authentic mid blue rigid-look denim. Cut with a high-waist and a tapered leg, they are finished with multiple pockets, classic trims and cool clear knee panel detail.”

And you can get them for the low-cost of $95!

I’ve stared at these pictures for a solid few hours now and I still don’t get it. Let’s look at the basic facts. The clear panelling disrupts the whole look of the jean. I also imagine they aren’t incredibly comfortable. Have you tried to wear something that is made of plastic? It sticks, makes funny sounds when you move, and is not exactly the most pliable of materials. What happens when you sweat? Topshop claims the paneling adds a “futuristic feel” to the pant, but let’s be real. In the future, I would hope people would be more creative then plastic knee windows.

If it’s meant to be a sexy thing, for people who don’t like the look of their calves but want to show off their awesome knees instead, I think it also fails. The knee isn’t exactly the most sensual part of the body. Yes, in some cases, it is considered one of the erogenous zones on the body, but it’s not going to do much for people simply to look at them, unless you are into that kind of thing.

Ultimately, I think this is an incredible waste of a hundred dollars. As a writer, I wish I had a better word to use than this, but, these jeans are just weird. Hopefully, this is a fad that will come and go. If not…I may have to avoid buying jeans altogether.

Woman of the Week: Manjit Minhas

Be concise and know your financials — that’s Manjit Minhas’ advice for young entrepreneurs pitching their business ideas.

Minhas is the co-founder and CEO of Minhas Brewery, Distillery, and Winery, and is one of Canada’s new Dragons on the hit CBC show Dragon’s Den. She is a straight-forward and blunt businesswoman with an incredible passion for innovative ideas. When she speaks of the new products she is constantly exposed to on Dragon’s Den, she does so with tremendous respect and excitement.

“I see myself in a lot of these entrepreneurs,” she says. “I know there is no book to map these challenges. I love that I can help guide them and, on the flip side, help people stop when I think they are dumping their own money, and sometimes other people’s money, on something that in my experience is not going to work.”

“If I can save someone’s livelihood, that’s necessary and my role as a mentor and venture capitalist.”

The 36-year-old started her own business at the age of 19 after her first year of university, where she was studying petroleum engineering. At the time, her father had been let go from the oil patch and decided, with much pushing from his friends, to go into the liquor business. He purchased three stores in Calgary. Minhas and her brother grew up in the industry and both realized there was an opportunity for growth.

The siblings sold their car for $10,000 and launched Mountain Crest Spirits. “I discovered that bars and restaurants were not brand loyal,” Minhas says. “They were looking for cheapest bar stock that week.” The idea was to create good quality spirits that, because of the low price, restaurants would become accustomed to and the result would be loyalty. Tequila and Irish cream were some of their best sellers.

“Our goal was, service, quality, and volume volume volume. That was the start of our real big empire story.”

In 2002, they launched into beers. Their first beer, a classic mountain lager, was made with only four ingredients and sold for only a dollar, which was unheard of at that time. They eventually purchased their first brewery in Wisconsin — the second oldest brewery in the U.S. — and since then, the company has grown immensely. Minhas and her brother now have breweries in Calgary and Mexico, as well as two wineries in Chile. Their products are sold throughout Alberta, Saskatchewan, British Columbia, Ontario, and Manitoba, as well as 43 states throughout the United States and 15 other countries in Europe, Asia and South America.

In 2016, Minhas’ companies made over $187 million in revenues. Minhas has been honoured with several industry awards for her success, including PROFIT magazine’s “Top Growth Entrepreneur”, Top 100 Women Entrepreneurs in Canada, Canada’s Top 40 under 40, and the Sikh Centennial Foundation Award, among others.

“I can say I didn’t have much of a typical university life, but no pain no gain,” she says. “My sacrifice was my 20s, and I guess I say my education because I could have done better. I had other dreams and passions and I’m glad that I did. I don’t regret the last 17 years.”

Minhas is constantly looking for ways to expand and grow her thriving business. They started to fashion new beer flavours, even appealing to the gluten-free crowds and the boxer beer enthusiasts. When Minhas purchased her first brewery in Wisconsin, she also happened upon the rights and recipes to the old-fashioned soda the facility owner made during prohibition. This inspired her to continue that business, selling soda and soda-inspired nano-filtration boxer beer. This summer, they are adding new flavours of boxer beer, including black cherry and ginger. Last year, they added hard root beer, grape, and cream soda to their repertoire.

“We had a great award-winning soda line that we added clear malt base too — a proprietary method we have discovered,” she says. “We clarify it and it becomes colourless, tasteless, odourless and we add alcohol to the soda. There is no bad aftertaste of beer because we’ve taken that taste out in order to taste the soda, unlike other brands in the market. Innovation is key to success.”

In 2015, Minhas was invited to appear in Dragon’s Den, a Canadian reality television show that allows entrepreneurs to pitch business ideas to potential investors — known as “the Dragons”. She prides herself on her bluntness and her honesty, but above all else, she loves the mentoring aspect of the show. Minhas says she was surprised by how many products she has seen that didn’t already exist in the market. Her investments are plastered proudly all over her website.

“I do believe it’s important for women to support each other and people in different industries to talk to each other,” she says. “In my industry, there is not a lot of women. It’s about guiding a newcomer, a new entrepreneur through the challenges everyone has — work-life balance, finances, regulation, all those things that are really generic to any business, human resources. That, I feel, is my biggest contribution.”

Minhas starts filming season three of Dragon’s Den at the end of this month.

What Buffy the Vampire Slayer taught me as a feminist

**Warning: May contain show spoilers.

Over the last few months, I’ve slowly been re-watching one of my favourite science-fiction television shows — Buffy the Vampire Slayer (BTVS). Little did I know that just as I opened the first episode of season five (thanks Netflix), I would be surprised by the following announcement.

It is the show’s 20th anniversary.

The 1997 television drama merges high-school comedy and supernatural horror into one successful package. The storyline follows Buffy Summers, “one girl in all the world, a chosen one”, who has the strength to kill vampires and demons and save the world from multiple apocalypses — the plural of apocalypse has never been confirmed, even in the show. “I suddenly find myself needing to know the plural of apocalypse.”

Also, did I mention she is 16 and simply trying to get through high school in one piece without revealing her secret identity?

I realize this description may sound cheesy — and ultimately, the first few seasons of the show were just that. But, it was also good television. Joss Whedon, the show’s creator, knew how to merge all these great themes together in a way that made you laugh, cry, and yell at the TV with each plot betrayal. Many of the monsters Buffy fights are metaphors themselves for real-life high school issues. Inappropriate teacher-student relations, peer pressure, online dating, physical abuse, and, of course, teenage romance. All the while kicking serious vampire ass in high heels and a halter-top. Now, that’s female empowerment!

As Buffy grows older, the show introduced a lot adult themes like casual sex, employment, and the effects of alcohol. The characters viewers spent years getting to know started to change and grow. They went off to university, dealt with career transitions, and experienced intense loss. Buffy’s best friend Willow starts to build a relationship with fellow witch Tara in what was my first introduction into lesbianism as a teen. This exploration of sexuality was done in such a subtle and honest way that it just seemed a natural transition for the character, and for the viewers.

What does this all have to do with feminism, you may ask? The whole idea of BTVS was that a young girl, someone who is often overestimated in intelligence and strength, has the ability to conquer the worst evils the world has ever seen. She has boyfriends, sure, but usually she is the one doing the rescuing. As she tells her sister Dawn, “no guy is worth your life, not ever.”

In the end, Buffy becomes the idealistic female superhero. Sure, she has a few male sidekicks and a British father figure to offer guidance, but at the end of the day, it’s Buffy’s plan, her leadership, and her sacrifice that saves the world.

And then, there is the last season (note: serious spoilers ahead).

As Willow and Buffy work together to break the “one chosen one in all the world” curse, her strength and power is transported into all the potential slayers around the world. From the young teenagers fighting the ultimate evil to the six-year-old playing baseball in the park, that energy flows within them, making them stronger and more capable then ever before. Now, it’s up to all of womankind to fight the battle. Could there be a more perfect symbol for female strength and unity?

At the end of the series, she doesn’t get the guy. In fact, she is independent, standing among the rubble of the apocalypse she helped prevent, with her friends and family by her side. She is strong, stoic, and just plain awesome.

If I wrote an article about all the things I learned, and continue to learn, from this amazing 90s television show, it would result in an essay over 10,000 words in length. Every few years, I re-watch BTVS and find something I previously missed. I usually watch it when I need to rejuvenate my sense of purpose or when I’m feeling down after the end of a relationship. Buffy the Vampire Slayer isn’t just a quirky teenage drama with lovable characters and a few evil vampires to fill in the space. It is a coming of age tale that represented all of the good and bad elements involved in growing up. Underneath the supernatural magic of this television show, BTVS is able to accurately portray the effects of death and trauma on a group of young kids, while still instilling hope in those who were watching it.

Not many television shows nowadays can make that same claim.

All of this is to say, happy 20th anniversary BTVS! I have no doubt that, in another 20 years, people will still be talking about this iconic and empowering series.

Are Canadians investing in women?

March 8 is International Women’s Day. During this time, it’s easy to think back to all of the trials and tribulations women have experienced. Just last week, there was a tragic case in Halifax in which the victim of sexual assault was wronged thanks to an outdated definition of consent. There has been a large investigation into “unfounded” sexual assault cases by the Canadian police. And of course, there is the incredible sexism women are facing in the United States from their own politicians.

No, Women’s Post is not going to focus on that this March 8 (at least, not too much). Instead, Women’s Post is choosing to celebrate this important day by speaking with successful business women, gathering their advice for other women, and learning about who they invest in. Here is a teaser with some of the results:

What is consent?

“A drunk can consent.” This statement was said by Judge Gregory Lenhan following a sexual assault trial in Halifax in which he acquitted a man who was practically caught red-handed trying to have sex with an unconscious woman in the back of his taxi. Those four words have caused a public outcry, and a petition signed by 34,000 people is circulating asking for an inquiry into the judge himself.

Apparently, this whole idea of consent is rather confusing. So confusing that a judge, a man that has dedicated his life to justice and the law, thinks that sexual assault is something that can be decided be given without actually being conscious.

I know — I don’t get it either.

To help, let’s actually define the term consent.

Consent, according to the Oxford dictionary, means to give “permission for something to happen.” In the case of a sexual relationship, both parties must clearly agree to a sexual act and each person has the right to say no. Consent should never be assumed or implied. Seems simple enough, right?

What people tend to forget is that consent is continually. At any point during a sexual encounter, a woman or a man may tell his or her partner to stop — and that partner MUST stop. That is the nature of consent.

Therefore, considering that very basic definition, a person who is incapacitated through alcohol or drugs cannot give true consent.

In the Halifax case, the woman was found unconscious in the vehicle vehicle. She was naked and the taxi driver was found stuffing her pants and underwear into the front seat of his car. His pants were undone. The woman had an alcohol level of 241 milligrams per 100 millilitres of blood. This would have severely impacted short-term and long-term memory. Staff at the bar where the woman was picked up said she was incredibly drunk and was turned away at the door. That is when she hailed a cab.

Did I mention that her DNA was found in the accused’s mouth?

All of those details together should have resulted in a guilty verdict. Instead, the judge said there was no way to know whether the woman gave consent prior to her losing consciousness, and therefore the man could not be found guilty.

In essence: “a drunk can consent.”

This verdict verges on the ridiculous and unbelievable — and yet, it does not shock me. It doesn’t shock me because, as a woman, I know the judiciary system is not on my side. I know that, in the event of an unwarranted and unsolicited sexual act, it will take even more persuasion to convince a police officer that it was not my fault. And that’s a real shame.

Using the above definition, it is clear, without a doubt, there was no continual consent in the Halifax case. Even if the woman in the taxi urged the driver to have sex with her, the fact that she was unconscious nullifies whatever consent was originally given. The consent, at that moment, cannot be continual as the woman is not awake to give it.

Let me run through a few other scenarios in which consent is implied, but not actually given:

  1. A woman dresses provocatively, and that implies she is “looking to get some.”
  2. A woman invites you into their house or hotel room following a date, she is implying she wants to have sex.
  3. A woman asks a man if he has a condom. He puts it on. That means that sex is inevitable and what happens afterward is a consequence of that act. No one is allowed to change his or her mind at that point.
  4. A woman is intoxicated and their judgement blurred. That means they are looking for a fun time.

In all of these scenarios, a woman – or a man for that matter – has the right to change their mind and say no. None of these acts should be able to prove consent in the court of law, as consent is continual.

However, in many of these situations, lines are blurred and the judiciary system falls on “implied consent” rather than actual consent. There is also a double standard when alcoholism is thrown into the mix. How many times have you heard the defence say the following: “He was drunk, he didn’t know what he was doing. Let’s not ruin the reputation of this person based on one stupid choice.” The accused is then acquitted. When a victim of sexual assault says they were drunk, it is used to imply guilt and irresponsibility. This should not be the norm in our judiciary system.

That simple four-word verdict “ a drunk can consent” shows an ignorant and naïve understanding of the term itself. I am absolutely distraught and offended that a judge, someone who is in a position of power to determine whether or not a victim of sexual assault was in fact a victim, thinks it’s okay to make such generalized and harmful statements like this one.

Canadian women deserve better. They deserve not to be discriminated against in the court of law. They deserve to feel safe — and this can’t happen unless everyone is taught the real meaning of consent.
